Guidelines for Indian nationals to avail of the Amnesty declared by the Government of Kuwait

Dear Member of the Indian Community in Kuwait,

The Government of Kuwait has declared an amnesty for all illegal residents in Kuwait, valid from March 1, 2011, upto June 30, 2011.

Indian nationals who are presently illegal residents in Kuwait are encouraged to avail of the amnesty. The Indian Embassy has made arrangements at its premises in Daiya to assist them in doing so. About 200 Indians approached the Embassy today for the purpose.

The Indian Embassy Press Release reproduced below provides the requisite information for those who would like to avail of the amnesty. It is being put on the Embassy web-site and emailed with this letter to all Indian media representatives in Kuwait. All Indian Associations in Kuwait are also hereby requested to circulate it to their members. Money remittance exchanges functioning in Kuwait are also being asked to display the Press Release on their notice boards. It is also being translated into Indian languages that are widely used within our community in Kuwait, such as Hindi, Kannada, Malayalam, Tamil, and Telugu, so that it can be circulated in those languages.

The Government of the State of Kuwait has declared an amnesty to illegal residents in the State of Kuwait from March 1 to June 30, 2011. The procedures for availing the benefits of the amnesty scheme are given below:
SITUATION WHAT NEEDS TO BE DONE
  • Have Passport without valid /expired work visa or no residency permit (if absconding case filed by sponsor before 24/2/2011)
  • Entered with Visit Visa (now expired) but have not got residence permit
Directly leave Kuwait.
  • Loss of passport
  • Passport withheld by sponsors

1. Get new travel document (Apply for Emergency Certificate (EC)* in the Embassy with the requisite form dully filled in, 3 photographs and photocopy of their Passport/Visa/Ration Card/Indian Driving License/Voter ID Card and a fee of KD 1.550).

2. Then report to their respective Immigration Office with two photographs, for getting Exit Permit.

• Travel ban due to absence from work (absconding case filed by sponsor after 24/2/2011) Approach Immigration Investigation Authority at Shuwaikh for clearing the case.
Travel ban imposed by the Investigation Authorities / Court Cases Report to the Immigration Investigation Authorities and Immigration Office for getting Residency/Exit Permit.
Travel ban due to overdue financial liability Report to the Execution Department of the Ministry of Justice to settle their case, before departure.
Travel ban due to Criminal Case Report to the Investigation Department, Salmiya, next to Salmiya Coop.
New born babies without residency
  • Apply for EC in the Embassy with form duly filled, 3 photographs and photocopy of passports of the parents.
  • Report to Immigration Authority.
Pending cases with company for salary, terminal benefits, indemnity, etc. May give Power of Attorney to friend/relative and leave the country.
If you wish to obtain residency permits and are ready to pay corresponding fines You would be allowed to do so, without reference to the investigating authorities. Upon payment of the fines, status will be amended, subject to completion of all requirements for obtaining residency permit
Residency law violators arrested during the grace period Would be deported.
  • Illegal residents facing administrative or legal problems, preventing them from leaving the country can proceed to concerned Immigration Department to apply for a temporary residency permit.
  • Illegal residents who leave the country during the grace period would be exempted from punishment and fines, as stipulated in Amiri decree no. 17/1959.
  • Illegal residents who leave the country, based on stipulations of this decree would be allowed to return to Kuwait based on legal procedures, as long as no entry ban has been imposed on them for any other reason.
  • Illegal residents who do not leave the country during the grace period would be punished according to the law. No residency permit would be issued to them. They will be deported and not be allowed to enter the country again.

 

Procedure for obtaining Emergency Certificate

    • Come to the Embassy in person.
    • Application forms (available at the Embassy website www.indembkwt.org and obtainable at the Embassy) to be filled in.
    • 3 recent photographs to be attached with the application.
    • Produce (i) copy of Passport (ii) Civil ID (iii) Entry visa.
    • Pay consular fee of KD 1.550 (except in the case of destitutes).
