Amnesty begins March 1st: 4 months grace period

Monday, February 21, 2011

Four months of time will be given to residency violators to correct their status without penalty, starting from March 1st, Arabic daily reported quoting Assistant under secretary of the Ministry of Social Affairs and Labor, Mansour Al Mansour. Al Mansour said that the application submitted by the supreme committee for organizing expats in the private sector was approved and that they will be given 4 months, starting March 1 and ending June 30, 2011, to correct their residency status.

Expats can renew their residency or go back home without paying any penalties during this period. Further to this, the names of the violators will not be blacklisted from entering Kuwait and that their finger prints will not be taken if they decided to leave. Al Mansour said that there will be no restriction for their return if they decided to leave during the grace period.

I know one family who has come to Kuwait in August and could not apply for residency because the husband had problems with his old company. Now that issue has been solved and he wants to apply for residency (first time)
Does he have to pay for garama of his family? 2 kd each per person for the violation period?

Hi,

The amnesty given here means that only those people who do not have any registered criminal cases against them can utilize this opportunity. Most of the times if a domestic worker on article 20 runs away from home, his/her sponsor registers a complain at the police station. In such a case the runaway worker will have to ensure that all pending cases against him/her are settled before availing of the amnesty.

For workers whose passports have been confiscated by their sponsors, the Indian Embassy provides a temporary travel document. This issuance is subject to fulfillment of certain requirements by the Embassy and as such it is advisable that a request is submitted well in advance.

Good Luck.

Good news especially for domestic workers who have run away from their sponsors and are working illegally at other places.

Government should at the same time think to legalize the status of these runaway maids so they do not necessarily have to leave the country.

Good luck to those leaving to be with their families.
