Decree issued to amend the private sector labor law

An employee is entitled to full indemnity after years of service without deduction of the amount borne by the office due to subscription of the worker in the Public Institution for Social Security while in service. A decree was issued in this regarding to amend the private sector labor law in Article 51 and Article 70.

Article 70 states that the employee has the right to paid annual leave not less than 30 days and he is entitled to take leave in the first year after a minimum of six months at work under the employer. Weekends, public holidays and sick leaves should not be considered as part of the annual leave. The employee has the right to fractions of the year within which he worked for the employer, including the first year in service.

Kuwait labour law and concerned authorities are very much supporting the employees in kuwait. i request the authorities to fix a time period for the company's to pay the final settlement of resigned or terminated staffs. Still many companies are delaying the payment of indemnity. The employees are spending many months in Kuwait without salary, food and accommodation until company pay the benefits. Hope the authorities will solve these issues as soon as possible.

Labor law supports the rights of employees. Still many companies are delaying the payment of indemnity; because there is no time period in labor law for the final settlement of resigned or terminated staffs. Effectively after the notice period, many months are spend in Kuwait without salary, food and accommodation until company pay the benefits. Hope the authorities will address these issues also in near future.
