Crisis over Indian Community School continues

The crisis gripped the Indian Community School Kuwait reaches another level as the dispute between sponsor and the management continues. In a sudden move, the sponsor last day dismissed the current management board and appointed a new five member adhoc committee to manage the school. In a new development, last day, the sponsor called the principals of four schools and directed the principals to look after the administrative affairs of the school. Sponsor also appointed the principal of ICSK senior branch to coordinate the affairs of all the four schools, viz, senior, junior, Amman and Khaitan branches.

The crisis started last month when the school sponsor locked the board room and suspended the management board. After various discussions, the sponsor re opened the board room and allowed the management to function as usual.

While a section of the sources says the dispute is over allegations of mismanagement and irregularities, others said that the dispute is over the ownership of the land given by Kuwait government to build the new school in Mahboulla and the huge balance in school fund, which is amount to 3 million Kuwaiti Dinar.

The sources close to the previous board informed that the board is going to fight the issue legally and had approached India government and PMO regarding the issue. "The school board is democratically elected by the parents of Indian students and we will not allow anyone to play with the future of our students", one of the board member told IndiansinKuwait.com

Around 7000 Indian students are studying in the four branches of Indian Community School. Today the school is one of the best in Kuwait.

Sreedhar Dharmapadam was a unique Board members who was famous for creating total chaos among the teachers with high handed attitude . Mrs Julie George the then Principal was clear witness to his high handed behaviour... As they say the grapes are sour... Please find a better way to get your revenge

Sreedhar Dharmapadam tried his level best to continue in the board by sending in his CV for re-nomination but was defeated through a democratic election in the board with zero votes. The answer should be clear to all the Indians and parents

Well, it's ridiculous we say 700 students studying in ICSK.. well i will give my testimony it's the most careless institution i have been part of. My 2 daughter's being part of the Khaitan branch for nearly 9 years but my youngest child was not admitted reason being the admission was closed. Inspite of begging them I was told by the Hon. Principal to come next year he would guarantee my daughter a place. Come on whom are you cheating too a parent who want's all his children to study at same school. I guess now i realized that why my daughter was denied admission. since there are other things going on in school which is a shame.Now having the Prinicipals to govern the admin work too what else should be be expecting?. I guess the Indian Ambassador should intervene as it's about future of 700 odd students.

Whatever is happening presently is in a way better than the affairs continue to taking place under the existing board. Though they keep propogating that they are democratically elected body, it exists only for name sake nothing was democratic in the running of the board affairs. I have been part of this board for 5 years and lots of conduct of the board members only proves that this is totally a corrupt setup, not transparent, only few run the affairs inspite of the large number of them remain silent and never even show up to most of the board meetings. They concentrate more on other things to make some people famous within the community, rather than work for the development of the school. I have many instances to prove this point and in the name of free education lots of bungling is going on even from the time when the previous secretary was in office and continues to remain so even when the new secretary took over. My only desire is that this institution belongs to the community at large, and only parents who are educated enough (credentials to be evaluated) should run the show of the school and their tenure should automatically be terminated once their ward gets out from the school. There were many in the past who were part of this setup whose children never studied in ICSK schools, rather studying in other premium schools. It is highly suggested to handover the affairs of this setup to a representative appointed by the HRD Ministry as a director who can run this institution in an efficient manner. The existing board as appointed by the sponsor can remain so and work as advisors rather than getting involved in the day to day affairs of the school, that is the reason this board has been famous for all the wrong reasons all these years. The previous dispute during KP Mohan still remains unsettled, god only knows what remains in stock once new revelations come out since I know for sure that this board was never transparent in running the affairs.

Thanks for your article.It is really an eye opener to the community.Robbers cannot survive for lifelong.All so called board members are being there after tenure to enjoy robbery.They cheat us with corruption and enjoying with life by accumulated money.Many business tycoons on that so called board were using this amount as bank guarantees to run their biz.The so called secretary is behind all this activities.Sponser is better than these thieves.Let him assign for an assessment audit (not normal audit)and find out exact details.
I don't understand who is trying to make community to be panic?Schhols are working normal and already interim board is replaced with old one who faced allegations and corruption.
ICSK will have very good future with genuine leadership and no more robbers.

@ Mr.Saju. the school where my kids are studying will get fees concession only if they get 95% for all subjects in all the exams of the previous year In 9 th & 10 the standards.I hope if you can encoursge your kids to reach that score you also may be eligible for the fee concession.

Finally it will affect only the parents of ICSK. ICSK is the number one School in the middle East with best education and an affordable fees. ICSK is running by the Board for the last 56 years. It our duty to approach the Embassy to request to interfere and maintain the existing Board to run the School. Allegations will be come only where there the people are active.

Saying the Indian Community School-Kuwait is something that of the Indian community in Kuwait is nothing but a misnomer. B’coz it is not unlike the way it is/was projected. Given the Sponsor’s recent “taker-over” of ICSK, the questions vis-à-vis the ownership came into the fore once again.

What could be real structure of ownership this great institution ? Who are the owners and partners ? Have the Indian community got any role in ICSK and if so who n’ how deciding on who should be representing the Indian community in the governance of ICSK? Well..these are all some of the very relevant contemporary points.

I am not privy to any of the constituent document(s) or structure of ownership of ICSK, despite been a member in a ‘make-shift-namesake-body’ called PAC during 2010-2012. Any attempts to know this was looked down upon by many as taboos of enormous proportions !!

So I tend to see these aspects in a legal standpoint being a practicing legal professional in Kuwait. There could be two possibilities regarding its formation and ownership. (1) Sponsor had floated the institution entirely on his own as a single proprietorship or (2) Sponsor or sponsors floated it in partnership with certain other Indians. If it’s the case-1, the Sponsor, Ambassador Mr. Abdul Rahman Al-Essa could be the single owner or if its case-2, the Sponsor(s) holds the stakes of a minimum of 51% being the Kuwait national(s) and the remainder of 49% go the Indian partners.

Then again, if it’s a partnership as in the case-2, who are those venerable Indian partners and do they mandated to represent the Indian community thru’ the IndianEmb or they volunteered themselves to be the Partners on their own great social-commitments, in representative capacity?

I posed to some of these key-aspects recently to the Ex-Honorary Secretary of erstwhile ICSK-Board Mr. Vijay Karayil. While he largely remained incommunicado to most of them, all that he said was “Sponsor is not a Partner bcoz he has no investment. His contact is not that”.

Well..that position is not entirely right as per the law. Moreover, any contractual provisions that ultra vires any of the existing laws will not stand in the test of law. Irrespective of any actual investments or no-investment, sponsor will be a Partner and for that matter owner or part-owner of any institution or business he sponsored in Kuwait. (In a case where a sponsor had zero-investments, we used to put in place certain legal mechanism mainly to keep the equilibrium and to check a potential pulling the rug. I am not sure whether anything of that sort had made or not in ICSK.)

Later, in a discussion with a top source in the IndianEmb-Kuwait regarding ICSK-fiasco, he maintained that the “Embassy is neutral” in current issue bcoz “it is purely a private matter between the Ambassador Al-Essa and the ousted Board”.

So, it is all clear now. The concept of “ICSK-an asset of Indian community” is something that is deliberately or unintentionally being fed into the Indian community for the reasons best known or unknown to the ones who made it !!!

Hi,

I heard in ICSK schools they are giving around 250 students with no fees charging... Total 7000 students in ICSK.. Why they are not taking fees from 250 students. To obtain these without fee benefit what to do?.. In kuwait everybody came here with family for working and earning money. So why these students not paying the fees. Some vasta is there... This is not acceptable. In a school some students paying and some not paying? Somebody please clarify ?

I respect the principal, he is very nice but too much strict is not good, he should respect the parents, Vice principal is showing his eyes to me as I am child, orientation day I told him I have bathroom problem that's why I am seating at last, he said no, I am telling you seat here so you seat here, this is not good, he should respect the parents. Even they call us 10:30 am and started at 11:15 am, so I request them to value our time also

The present board has worked hard and given few major results which includes:

a) Good Standard of Education of the school
b) Best Education at very reasonable fee
c) Overall good results for the last 50 plus years

So where is the question of mismanagement. If it is something to do with some funds, then let there be proper auditing done and have proper controls defined. Just removing whole board is not justified.

I feel we should back the present board and pray that the differences are resolved amicably.

For a change it will be good. Let the sponsor and principal run the school. Board of members are seen only during carnival, for some school functions etc. Huge amount deposited in school nobody knows where it goes? Recently they charged 2 kd for Arts fest without parents knowledge. Just imagine 7000 kids paying 2 kd where only few students will be participating. This PAC member should had objected.

Let us all send emails to our respected Ambassodar requesting him to investigate impartially the actual cause of dispute. The facts should be published in media for all the Indians to know. Unused funds of KD.3m should be freezed in Bank till the matter is resolved.

ICSK has been a crown for the INDIAN community students and others, for its effective functioning with lower costs levied and results that were well on-display during final exams.

FYI, certain ex-board people who lost the elections last time, are meddling with the affairs of the school by getting the sponsor to take direct control over the "Indian-Community" school.

Such evil doers, had only this option list after they could not give up the greediness (because of which they lost the last board elections)

While the ex-board members will blame the present board members, you have 2 choices :

a) Wait and watch as our children and parents suffer (or)
b) Indian Community needs to rise to the occasion and place this before the Ambassador of India.

Dear friends,

I have been part of the school for a long time and have known all the Board Members for over 2 decades.

Many may speak ill of Board and their actions. But let me tell you, if Board was NOT managing all these years, the school would have charged a LOT to their students and parents would have seen the difference than other schools managed by Kuwaiti Sponsors in those schools....

It is NOT good to give away the school to Sponsor to manage, after running the school so effectively for over 50 years by Indian Board of Management...

Principals of all the 4 branches are very good in running the schools academically with the CONTINUOUS support and ideas suggested by BOT and Parents teams... It would become TOO difficult to handle the Day-to-Day management directly under Khafil's instruction...

United we stand... We SHOULD NOT leave this school to be managed by SPONSOR... It should still be managed by our own BOT.

Don't curse the BOARD for the management... we may have to pay HIGH PENALITIES when we offer it to SPONSOR to run the school, when your concerns WILL NEVER be heard by anyone and you will have NO OTHER WAY ... than to ACCEPT their verdict...

Parents who are complaining now for this and that issues... CANNOT have any voice to raise their CONCERN.

STICK IN TIME, SAVES NINE.

Embassy of India, Kuwait or PMO office or MEA DO NOT have much in this concern... though they can only bring this to attention of Government officials in Kuwait. IT is totally OUR OWN ISSUE.

Parents should request our Indian Embassy to take care of the matter at the earliest before those KD.3 million disappears. If Indian embassy takes the matter in the govt. level then nobody play foul in this matter. Also,if necessary, parents can write to Indian PMO's office for the matter.Sooner it is done better for our children.
